How to Correct Violations

Building owners can check for open violations online using the HPDOnline application. Building owners may have corrected violations removed from the record by certifying, either by mail or online ecertification, that the violations were corrected within the required time period specified on the Notice of Violation. Click here for HPD’s notification of correction of violation online eCertification program or see certification instructions on the back of the Notice of Violation if you chose to mail certification of correction of violation. After the specified time period has passed, building owners may file a Dismissal Request form with their Borough Code Enforcement office for a fee.

Certification of Correction of Violations: (in PDF) This form is for use when all violations on a Notice of Violation cannot be certified at one time or you do not have the original Notice of Violation. This form must be completed properly, including identifying the original NOV ID, signing the form and having the form notarized, for it to be accepted by HPD. The form must be returned to the same borough office indicated on the original Notice of Violation. THIS FORM CANNOT BE USED FOR HEAT OR HOT WATER VIOLATIONS OR LEAD-BASED PAINT VIOLATIONS.

This form is for use when all violations on a Notice of Violation cannot be certified at one time or you do not have the original Report of Violations. The form must be returned to the same borough office indicated on the original Notice of Violation (the Borough Office for the borough in which the building is located). Contestation of Lead-Based Paint Violation (Form L06): Under Local Law 1, HPD may issue presumed lead-based paint violations. These violations have an order # of 616 associated with the violation. If a presumed lead-based paint violation is issued, you will receive with the Notice of Violation a form called an L-06. Form L06 allows you to contest the violation using XRF testing or, in certain cases, paint chip sampling (read the form carefully for details).
Violations Re-issuance Program: The Violations Reissuance Program is a program that provides owners whose properties are eligible for participation with an opportunity to have overdue or old HPD violations removed from HPD's records without paying a fee as long as the appropriate information is submitted to HPD on or before the deadlinestated on the Notice of Violations form. To request a violation reissuance, submit a properly completed Form RV1 to the Division of Code Enforcement at 100 Gold Street, Rm. 4-P6, New York, NY 10038. Owners and other interested parties can obtain print-outs of outstanding building violations for the cost of $.25 a page (for 1 to 14 violations and $30.00 for 15 or more violations) by contacting the Borough Code Enforcement Offices.
